REFUGEE APPEALS — RAD
Refugee Appeal Division Representation
A negative refugee decision may, in eligible circumstances, be appealed to the Refugee Appeal Division.
The RAD considers certain appeals from RPD decisions, but not every claimant has access to a RAD appeal.
Where a right of appeal exists, we can assist with reviewing the Refugee Protection Division decision and the record of the claim.
Services may include reviewing the written reasons, identifying potential appeal issues, reviewing evidence, preparing the appeal record, preparing written submissions, considering proposed new evidence where legally permitted, and representation in eligible RAD proceedings.
Appeal deadlines may be strict, so clients should seek advice promptly after receiving a negative decision.
SPONSORSHIP APPEALS — IAD
Was Your Family Sponsorship Application Refused?
Certain eligible sponsors may have the right to appeal a family-class sponsorship refusal to the Immigration Appeal Division.
A sponsorship appeal may require much more than simply resubmitting the original application.
We can assist eligible clients with reviewing the refusal decision, identifying the issues in dispute, examining the original application, organizing additional evidence, preparing the sponsor and applicant, preparing witnesses where applicable, preparing written submissions where appropriate, and representation before the IAD.
The existence of an appeal right depends on the particular decision and circumstances.
RESIDENCY-OBLIGATION APPEALS
Protecting Permanent Resident Status
Permanent residents must meet Canada's applicable residency obligations.
In certain circumstances, a negative residency-obligation determination can be appealed to the Immigration Appeal Division.
We assist eligible clients with reviewing their travel history, time spent inside and outside Canada, reasons for absence, family circumstances, establishment, relevant humanitarian considerations, and supporting evidence.
Services may include appeal preparation, documentary evidence, witness preparation where appropriate, hearing preparation, and representation before the IAD.
REMOVAL-ORDER APPEALS
Facing a Removal Order?
Certain individuals may have a right to appeal a removal order to the Immigration Appeal Division, depending on their status and circumstances.
Where an appeal right exists, we can assist with reviewing the removal order, immigration history, relevant evidence, family circumstances, establishment, rehabilitation-related information where relevant, humanitarian considerations, witness preparation, and hearing preparation.
We also provide representation in eligible IAD proceedings within our professional authorization.
DETENTION REVIEWS — ID
Immigration Detention Representation
The Immigration Division conducts detention review proceedings for individuals detained for immigration reasons.
Detention matters can be highly time-sensitive.
Services may include reviewing the reasons for detention, immigration history, supporting evidence, possible release arrangements, proposed bondsperson information where applicable, client preparation, witness preparation, and representation at eligible detention review proceedings.
ADMISSIBILITY HEARINGS — ID
Representation in Admissibility Proceedings
The Immigration Division conducts admissibility hearings involving allegations that a foreign national or permanent resident may be inadmissible to Canada.
We assist eligible clients with reviewing the allegations, immigration documentation, supporting evidence, relevant personal circumstances, and hearing materials.
Services may include client preparation, witness preparation where appropriate, organization of documentary evidence, written materials, and representation before the Immigration Division.
